WildWestGunStore is a trading name of GMC Eurl. These terms and conditions of sale apply exclusively between GMC Eurl, WildWestGunStore, and the online customer of www.wildwestgunstore.com.

ARTICLE 1 - PRICES

The prices of our products are listed and payable in euros, inclusive of all taxes, but excluding processing and shipping fees. Goods remain our property until full payment is received.

All prices are subject to correction in the event of a manifest typographical error. Should such an error occur, GMC Eurl reserves the right to invoice at the corrected price. Once notified, the customer has the right to cancel their order and receive a full refund.

The price of products out of stock or being restocked is not guaranteed; however, once notified, the customer has the right to cancel their order and receive a full refund.

ARTICLE 2 - ORDER

The firearms sold on the website www.wildwestgunstore are reserved exclusively for adults under French law in effect on the date of the order.
By placing an order on the website, the customer acknowledges having read and accepted the General Terms and Conditions of Sale. Our collectible firearms are sold without any performance guarantee due to their antique nature. For safety reasons, ammunition is neither returnable nor exchangeable.
The information entered by the customer, particularly their address, is binding upon them, and our company cannot be held responsible for any damages resulting from customer errors.
Deliveries are made exclusively to the customer's address and under no circumstances to a third-party address.
Our company reserves the right to cancel or refuse any order from a customer with whom there is an unresolved dispute at the time of the order.

For any order outside of France, please contact us before confirming your order, as fees or legal formalities may apply or prohibit the sale.

Our offers are valid while supplies last.

ARTICLE 3 - VALIDATION - REGULATIONS

Upon registration of your order, if necessary, you will receive a request for information in accordance with French regulations. The buyer agrees to respond within 3 business days:

- For Category D firearms, please provide a copy of both sides of your identity card or passport. No further formalities are required from you or us.

- For Category C firearms, in addition to the above, please provide a copy of your valid shooting license or hunting permit. Our company will handle the Finiada control and registration formalities with the relevant authority. In the event of incorrect information or infeasibility (e.g., if the individual is prohibited from acquiring and possessing weapons), our company reserves the right to charge the buyer for the time spent.

ARTICLE 4 - AVAILABILITY

Our product offers and prices are valid as long as they are visible on the website, within the limits of available stock.
In the event that a product becomes unavailable after you have placed your order, we will inform you by email as soon as we receive this information from our suppliers. The customer will then have the option to maintain or cancel their order.

ARTICLE 5 - DELIVERY

Products are delivered to the shipping address provided when placing your order. Once the order has been validated and paid for, the usual processing time is one business day for order preparation, plus an additional two to three business days for transit. Shipments are generally dispatched at the beginning of the week.
Unless otherwise requested, firearms and collectible products are sent via registered Colissimo with signature upon delivery. Small parts are shipped by tracked mail.
Customers may also arrange collection through a carrier of their choice, who can pick up the goods directly from our showroom.
A flat fee of €25 is charged for optional additional insurance coverage of up to €5,000.
In the event that a parcel is damaged or shows signs of deterioration, it is essential to make specific reservations with the carrier upon delivery and have the damage officially recorded. Failure to do so may result in the insurance claim being denied.
We also offer free order collection from our showroom in Montmorency (95), strictly by appointment only.

ARTICLE 6 - PAYMENT

Payment for your order can be made:

- By credit card via our secure payment system.

- Payment in installments via ALMA X3 and X4 up to €2000

With prior agreement, payment can be made in installments over a maximum period of 3 months after payment of a non-refundable deposit of at least 10%. After receipt of the final payment, the product will be shipped to the customer. If, at the end of the agreed period and within a maximum of 3 months, the product has still not been paid for in full, the seller may relist it for sale without the customer's consent. The deposit and the seller's fees will be deducted from any refund due to the customer.

We reserve the right to cancel the order in the event of non-payment, with any costs incurred remaining the responsibility of the buyer.

ARTICLE 7 – RIGHT OF WITHDRAWAL

In accordance with current legislation, the buyer has 14 days to return the product purchased on our website. The withdrawal period begins 14 days after delivery or receipt by the buyer or a third party of their choosing, without the need to provide a reason.

To meet this deadline, the buyer must send us, by registered letter with acknowledgment of receipt, within the legal timeframe, an unambiguous letter stating their intention to withdraw to our registered office address: Wildwestgunstore – 1 chemin des écureuils - 95680 Montlignon, France.

Simply returning the goods without notification or refusing delivery is not sufficient to express your intention to withdraw.

From the day of notification of their intention to withdraw, the buyer must return the product(s) to the seller without delay and, in any event, no later than fourteen days.

The risks and costs of the return are borne by the buyer. Only new products returned complete, clean, and in perfect condition will be accepted. Antique weapons must not have been disassembled or tested, and collectibles must not have undergone any alteration. Otherwise, the return will be considered non-compliant and will either not be refunded by the Seller or will be accepted with a deduction.

Shipping costs remain the responsibility of the buyer, as well as any costs incurred for this order, including legal procedures.

ARTICLE 8 - PRODUCT WARRANTY

The manufacturer's legal warranty for a new product is two years. It takes effect from the date of receipt of the package. It covers the repair of the product (parts and labor). Products that have been modified, disassembled improperly, or used outside the manufacturer's recommendations are not covered by the warranty. Wear parts are not covered. The legal warranty against hidden defects on new products is separate from the legal warranty.

Warranty claims for collectibles cannot cover items displayed on the website www.wildwestgunstore.com prior to purchase or visible to the customer during their withdrawal period. Under no circumstances can such claims be made for items related to any use for shooting.

To exercise their legal warranty rights, the customer must notify us in advance by registered letter to our headquarters.

The product must be returned at the buyer's expense and risk.

ARTICLE 9 - TRANSFER OF OWNERSHIP - TRANSFER OF RISK

Ownership of the products will only transfer to the customer upon full payment of the price, regardless of the delivery date.

However, the risk of loss or damage to the products will transfer to the customer upon delivery and acceptance of said products. GMC shall not be held liable for any material, immaterial, or physical damages resulting from malfunction, modification, disassembly, or misuse of the products, or from the buyer's failure to comply with regulations.

ARTICLE 10 - INTELLECTUAL PROPERTY

All texts, comments, illustrations, and images reproduced on the wildwestgunstore.com website are protected by copyright and intellectual property rights worldwide. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is permitted, subject to any different or more restrictive provisions of the Intellectual Property Code. Any total or partial reproduction of the website is strictly prohibited. Photos of our articles or products remain our property and may continue to be used after their sale.

ARTICLE 11 - APPLICABLE LAW - DISPUTES

All articles contained in these general terms and conditions of sale, as well as all purchase and sale transactions covered herein, are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.

In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes and Article 14 of EU Regulation No. 524/2013, the European Commission has established an Online Dispute Resolution (ODR) platform.

Therefore, if you encounter a problem with an order, after having first attempted to resolve the issue in writing with the seller without success, you may contact the European mediator. Complaints or disputes will always be received with careful attention, as good faith is always presumed on the part of those who take the time to explain their situation.

ARTICLE 12 - PERSONAL INFORMATION

As your information is confidential, GMC Eurl, Wildwestgunstore, undertakes not to disclose it to third parties.

In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify, and object to the processing of their personal data.

To do so, simply send your request directly by email or postal mail, indicating your contact information.
